These Terms of Use (“Terms”) are an agreement between FSBO TOWN (“FSBO Town,” “we,” “us”), with offices located at 303 Broadway, Laguna Beach, CA 92651, and you (“Subscriber,” “you”). By accessing or using FSBO Town websites, applications, data products, or services, you agree to these Terms.
FSBO Town grants you a limited, non-exclusive, non-transferable, revocable license to use the Software solely for its intended purpose. You agree not to reverse engineer, decompile, translate, redistribute, share, or copy the Software without express written consent. You are responsible for safeguarding usernames/passwords and preventing unauthorized use of your account.
License. FSBO Town grants a limited, non-exclusive, non-transferable, revocable license to use FSBO Town Leads that you purchase as part of your Subscriptions, solely for your individual business use.
Proprietary nature. FSBO Town Leads are trade secrets and proprietary information. You agree not to share, copy, reproduce, or redistribute FSBO Town Leads without express written permission.
Disclaimer. FSBO Town uses reasonable efforts to provide timely and accurate information and to acknowledge National Do Not Call Registry indicators where applicable; however, FSBO Town does not guarantee accuracy, completeness, or fitness for a particular purpose. Leads and services are provided “as is” without warranties of any kind.
The Software and FSBO Town Leads are protected by U.S. copyright and intellectual property laws. All rights, title, and interest remain with FSBO Town. These Terms grant you only the limited licenses described above.
You authorize FSBO Town to bill your payment method according to your Billing Cycle. Subscriptions renew automatically for successive terms equal to your plan unless you cancel as described in the Termination section below. If a payment fails due to expiration or other reasons, FSBO Town may continue attempting to charge your payment method. If payment is not made within 45 days of the bill date, your account may be terminated.
You agree to comply with all applicable laws and regulations governing calls, autodialing, email, and SMS texting, including TCPA and Do Not Call rules, and guidance from the FTC and FCC. Do Not Call compliance is solely your responsibility. FSBO Town is not responsible for subscriber misuse of any data, whether intentional or unintentional.
You agree not to contact emergency or life-line services (e.g., hospitals, police, fire, 911, utilities) and to consult an attorney if you are unsure about compliance obligations.
You acknowledge you may receive confidential information about FSBO Town, including methods, processes, pricing, customer names, and lead data. You agree to protect this information and not disclose it. All records and materials remain FSBO Town property and must be surrendered upon request or termination.
To the maximum extent permitted by law, FSBO Town is not liable for indirect, incidental, special, exemplary, consequential damages, or lost profits. FSBO Town’s total liability will not exceed the license fees paid for the applicable Software or service.
You agree to indemnify, defend, and hold harmless FSBO Town and its employees, officers, and directors from any claims, damages, losses, liabilities, actions, or expenses (including reasonable attorneys’ fees) arising out of your use of the service, your account, or your communications and marketing practices.
FSBO Town is not responsible for service interruptions due to events outside reasonable control, including communications failures, labor disturbances, governmental actions, accidents, fires, terrorism, or similar causes.
These Terms are governed by California law, and you consent to jurisdiction in state and federal courts located in California.
FSBO Town may terminate service at any time at its sole discretion. You may cancel by emailing support@fsbotown.com or by mailing a written cancellation request to: FSBO Town, 303 Broadway, Laguna Beach, CA 92651.
To avoid renewal, cancellation notice must be received at least one (1) business day before your next Billing Cycle begins. Failure to cancel prior to the end of a Billing Cycle does not justify a refund. Not using your account does not justify a refund.
FSBO Town does not guarantee 100% accuracy of results, and there is no expectation of refunds due to data inaccuracy. If FSBO Town is unable to resolve technical issues, Subscriber may terminate service with no expectation of a refund of fees.
We may update these Terms from time to time. Continued use of the site or services after changes become effective constitutes acceptance.
